Frequently asked questions

Is an NDIS service agreement legally binding?

A signed service agreement is a form of contract between you and the provider, so both sides are expected to stick to what it says. That is why it is worth reading carefully and getting the terms clear before you sign. It is not an NDIA rule that you must have one for most supports, but once you both sign, the terms generally apply.

Can I have supports without signing a service agreement?

For most supports, yes. The NDIA recommends agreements but does not require them in most cases, though a provider can make a signed agreement a condition of working with you. Specialist Disability Accommodation is the main situation where a written agreement is generally required. Even when it is optional, having one in writing protects you.

What if I do not understand something in the agreement?

Do not sign until you do. You can take the agreement away, ask the provider to explain, or get help from a support coordinator, a family member, or a free independent advocate. A good provider will give you time and answer your questions plainly. Feeling rushed is a reason to slow down, not speed up.

Will the NDIS reforms change my existing service agreements?

Your existing agreements do not automatically disappear. What changes is the plan behind them: from 1 April 2027 the budget structure is being reworked, and participation-support funding is being reset from 1 October 2026 as plans renew. When your plan changes, you may need to update agreements to match it. Dates have already shifted once, so confirm current timing with the NDIA.

How do I get out of a service agreement I am unhappy with?

Check the notice period written into the agreement, then give notice in writing so there is a record. Try to raise the problem with the provider first, and keep copies of everything. If it cannot be resolved, you can contact the NDIS Commission on 1800 035 544. A dedicated guide on leaving a provider covers how to avoid a gap in supports.
