Do I need a conflict of interest declaration if I only recommend external providers I have no connection to?
No formal COI declaration is needed where you have no relationship, benefit, or tie to the provider — that is ordinary independent coordination. Still document that you offered the participant genuine choice. Use a declaration the moment any relationship, employment, ownership, referral arrangement, or benefit enters the picture.
Can I coordinate supports and also provide the participant's SIL through my employer?
It is high-risk and sometimes unmanageable because you influence funding decisions that benefit your employer. If your organisation permits it, disclose in writing, give real alternatives, and ideally have a different coordinator handle any decision about the in-house service. If you cannot separate the roles, treat the conflict as unmanageable and refer the decision on.
Is disclosing the conflict enough to comply with the NDIS Code of Conduct?
No. Disclosure is necessary but not sufficient. You must also give the participant genuine, unpressured choice, document their decision, and put management controls in place. For unmanageable conflicts you must step back from the decision or decline the work — a signed form does not override that.
Who signs the declaration if the participant has a guardian or nominee?
The decision-maker signs — that is the person legally or formally authorised to make the relevant decisions (guardian, plan nominee, or the participant themselves where they have decision-making capacity). Record the participant's own views alongside, even where someone else signs.
How often should I review a conflict of interest declaration?
Review at each plan check-in or reassessment and whenever a triggering circumstance changes — your employer, ownership, family or referral relationships, or the participant's providers. A declaration is a live document, not a one-off.
