What is the new Aged Care Act?
It is Australia's reformed aged-care law, commenced on 1 November 2025, replacing the 1997 Act. It creates a rights-based system built around a Statement of Rights, seven strengthened Quality Standards, stronger provider obligations and public star ratings for aged-care homes.
What rights does the Statement of Rights give me?
It protects your right to independence, choice and control, fair access to care, safe and respectful treatment, dignity and privacy, having your voice heard, and support, connection and cultural safety. Providers must deliver care in line with these rights.
Does the new Act change what I pay?
It frames the new funding rules — Support at Home for home care and reformed residential contributions. Clinical care at home is free, with means-based contributions elsewhere. 'No worse off' protections mean grandfathered recipients are not asked to pay more towards care than before.
What can I do if my rights are not respected?
Raise it with your provider first. If that does not resolve it, contact the Aged Care Quality and Safety Commission or get free, independent help from an aged-care advocate. Raising a concern is your right, and it should not affect your care.
