Do I legally need a written service agreement for every participant?
No single law forces a written agreement for every support, but it is strongly expected under the NDIS Practice Standards and is effectively required for GST-free treatment of most supports. For ongoing supports, and always for SIL, use a written agreement. Confirm current requirements with the NDIS Quality and Safeguards Commission.
Can I charge more than the PAPL price?
No. The PAPL sets the maximum you may charge for a support. You can charge less, but never more. Because a new PAPL applies from 1 July each year (the 2026-27 PAPL applies from 1 July 2026), confirm the live line item before you invoice.
How should I handle cancellations and no-shows?
Follow the short notice cancellation rules in the current PAPL, which set the notice period and an annual cap on how much you can claim. State the current rule in your agreement rather than a fixed number, and only claim for cancellations where you were genuinely available to deliver.
Are NDIS supports GST-free?
Generally yes. Supports for a participant with an NDIS plan are typically GST-free under the GST Act where there is a written agreement, which is one reason to have one. Some supports may not qualify, so confirm the treatment for your specific items and show GST separately where it applies.
Does registration status change what goes in the agreement?
Yes, record it accurately. SIL and digital-platform provider registration commenced 1 July 2026, with mandatory registration expanding to higher-risk supports from 1 July 2027. Differentiated pricing for unregistered providers is under consultation in the second half of 2026, so registration status may affect future pricing. State your status honestly.
